Although there are thresholds for audit exemptions in the Companies Act, the Income Tax Act provides that all tax returns for companies need to be accompanied by a set of audited financial statements. In order to satisfy this latter regulation, all Malta registered companies require to prepare audited financial statements annually.
Only Malta companies that perform trading economic activity in Malta need to register for VAT in Malta. Depending on the type and location of activity, a Maltese registered company may be required to register for VAT in another EU member state.
The returns that need to be filed with the VAT Department in Malta are the VAT Declaration/Return and the Recapitulative Declaration (services) . The Intrastat Declaration (goods) is submitted to the National Statistics Office.
We do provide assistance to European Union nationals to become resident in Malta. EU nationals that are resident but not domiciled in Malta are taxed at standard Maltese income tax rates on the foreign income remitted to Malta. Typically a Malta company is required to submit audited financial statements and a tax return to the Commissioner for Revenue (CFR) covering 12 months. This is usually a calendar year. The first period covered may be shorter or longer. The director of the company may also opt to change the annual accounting year end date.
